These General Terms and Conditions of Sale (GTC) govern sales concluded between Stimultania – photography center (hereinafter “Stimultania”) and individual customers (hereinafter “the Customer”), within the framework of the online store available at: https://www.stimultania.org/boutique/They define the rights and obligations of each party for any order placed on this site.

3. products
The products offered are those listed in the three categories "Click Words," "Publishing," and "Other." Each product includes a description (content, features, images) and a price inclusive of VAT in euros (excluding delivery charges). Images are for illustrative purposes only; differences may exist between the product and the actual product.
4. Price
Product prices are displayed in euros (€), inclusive of all taxes, and do not include delivery charges, which are the responsibility of the customer. Delivery charges, when applicable, may vary and are specified during order confirmation. Product prices and delivery charges may be modified at any time by Stimultania, particularly in the event of increased costs, changes in the VAT rate, or in the event of a manifest error; however, the price charged will be the one in effect at the time the customer confirms the order.

The ordering process is as follows: product selection, choice of shipping method, calculation of shipping costs, acceptance of the Terms and Conditions, confirmation, and payment. The order is firm and final once full payment has been received and the Customer receives an order confirmation email from Stimultania. Stimultania reserves the right to refuse any order in the event of payment issues, stock availability problems, or a prior dispute with a Customer.
6. Payment
Payments are made online via PayPal. However, you don't need a PayPal account; you can pay directly on the PayPal platform with your credit card. The order confirmation date corresponds to the date of online credit card payment. The products remain the property of Stimultania until full payment is received.
7. Delivery
Products are delivered to the address provided and according to the shipping method chosen by the Customer at the time of ordering. Once the order is placed by the Customer, Stimultania ships the order within a maximum of 15 business days. Once shipped, delivery may take 3 to 5 business days for mainland France, Corsica, and Monaco. Public holidays are not counted as business days. Delivery may take 7 to 30 business days for international destinations. These are average delivery times depending on the destination, shipping method, and product availability. Stimultania cannot be held responsible for any consequences due to delivery delays caused by the carrier.
If, upon delivery, the original packaging is damaged, torn, or open, you must check the condition of the items. If they are damaged, you must refuse the package and note this on the delivery slip (package refused because it was open or damaged). Please note that if you refuse the package, it will be returned to us directly at no cost to you.
8. Right to retract
In accordance with the Consumer Code (articles L. 221-18 et seq.), the Customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without giving any reason.
To exercise this right, the Client must inform Stimultania by email at the address stimultania@stimultania.orgProducts must be returned to the following address: Stimultania, 33 rue Kageneck, 67000 Strasbourg, at the customer's expense. Returned items must be in new condition and in their original packaging to allow for resale. Any item not meeting these requirements will not be refunded or exchanged. In the event of loss or damage to the returned package, we will not be able to process a refund, and the buyer must file a claim directly with their carrier. If the returned products are in good condition, Stimultania will refund the customer the full amount paid (excluding return shipping costs) within 14 days of receiving the returned products.
9. Guarantees and conformity
The products sold benefit from the legal guarantees of conformity (articles L.217-3 et seq. of the Consumer Code) and of hidden defects (articles 1641 et seq. of the Civil Code). In the event of non-conformity or a defect, the Customer must contact Stimultania (email/phone) to arrange a return, replacement, or refund, as applicable. For returns of conforming products, the return shipping costs are the Customer's responsibility. The Customer will be offered a credit note or a refund for the value of the products at the time of purchase. For returns of non-conforming products, the return shipping costs are the Customer's responsibility. Refunds for the products and return shipping costs will only be issued after receipt of the returned products and confirmation of their non-conformity.
10. Intellectual property
All content (texts, images, visuals, logos, trademarks) present on the site www.stimultania.org These materials are the property of Stimultania or third parties who have authorized their use. Any reproduction, representation, modification, publication, adaptation, exploitation, or commercialization, in whole or in part, of these materials is prohibited without prior written authorization.
11. Personal data
Stimultania collects the data necessary for order management (name, address, email, telephone) as well as for shipping and invoicing. This data is used solely for order processing and is stored securely. The Customer has the right to access, rectify, delete, or restrict the processing of their data, in accordance with the GDPR and the French Data Protection Act. To exercise these rights, the Customer can contact stimultania@stimultania.org or the address mentioned in the privacy policy.
12. Liability
Stimultania cannot be held responsible for damages resulting from misuse of the products. In the event of force majeure (strike, delivery problems, natural disaster, etc.), Stimultania cannot be held responsible for delays or the inability to deliver.
13. Dispute Resolution
These Terms and Conditions are governed by French law. In the event of a dispute, the Customer is encouraged to first contact Stimultania for an amicable resolution. If no agreement is reached, the dispute may be submitted to the competent consumer mediator. Failing mediation, the French courts shall have exclusive jurisdiction to settle the dispute.
